ZUMBA FEVER PARTY 2
The Zumba Fever Party is subject to the following terms and conditions and by participating in the Zumba Fever Party, all participants will be deemed to have accepted and agreed to be bound by these terms and conditions. Please read the following carefully and seek clarifications if you do not understand any clauses.
INTERPRETATION
In these Terms and Conditions (“these Conditions”), the following terms shall have the following meanings:-
“We, us or our” | refers to the organizers namely Melvyn Goh, and Lisa Kong |
“Party” | refers to the Zumba Fever Party where the participants are attending |
“Venue” | refers to the place where the event is held, that is Zouk. |
“Date and Time” | refers to 18 April 2012 and the time where the event will begin |
1) PAYMENT
a) All tickets have to be paid upon receiving and before the Party starts on 18 April 2012 at 6:30 p.m. Once ticket is purchased and paid, they cannot be exchanged, refunded or returned unless the Party is cancelled, postponed to another date, or if the Party is significantly changed after an order is placed. Significant changes being a change of the headline act, venue or show time.
2) CANCELLATION AND REFUND
a) In the event of the cancellation of the Party by venue due to unforeseen circumstances, we will refund the full value of the ticket charged within the next 14 days of the day of the cancellation. We will use the best endeavours to contact the participants either by phone, SMS (short message service), email or in writing (using the information provided by the participants) and advise them of any action required for the refund to be processed.
b) No refund on tickets will be made under any circumstances except pursuant to Condition (2a) above, but tickets are transferable.
c) We would advise participants that no refunds will be offered to whoever is being refused entry or ejected from the venue on account of being underage, declining to be searched (if any), abusive, threatening, drunken or other anti-social behaviour (including smoking in no-smoking areas), carrying offensive weapons or illegal substances, or making unauthorized audio, video or photographic recordings.
d) We further reserve the right to cancel the Party in the event of unforeseen circumstances beyond its reasonable control.
3) DELAYS OR CHANGES TO THE PROGRAMME OFTHE PARTY
a) We reserve the right to make alterations to the advertised arrangements or featured guest/s and shall not be liable or be deemed to be in breach of the terms and conditions by reason of any delay in the event due to unforeseen circumstances beyond our reasonable control.
4) CONSENT TO USE PARTICIPANTS’ PARTICULARS FOR PUBLICITY PURPOSES
a) By participating in this Party, the participants acknowledge that photographs and/or video footage of them may be taken at the Party and they agree to take part in any promotion or publicity exercise as may be conducted by us, and the participants hereby irrevocably and unconditionally grant us all consents and waivers necessary for us to record and use the participants’ performance, appearance, likeness, name, voice and/or participants (as the case may be) in any manner as we shall in its sole discretion deem fit.
b) We reserve the right, at its sole and absolute discretion tousle, publish any recordings made by us, including without limitation, telephone recordings, audio recordings, visual recordings and photographs (if any), for the publicity, advertising, promotion purposes in any media of this Party (whether now or in the future) without first obtaining any consent nor making any payment whatsoever to the participants. Where permissible, each participant expressly waives all rights which the participant may acquire or have under the law (and any subsequent enactment or amendments thereto) and any other rights which the participants may have or be entitled to under the law.
c) The participants also hereby agree that we own all photographs and/or video footage of them taken at the Party and used by us and that we may copyright material containing the same.
5) CONDUCT AND CLAIMING OF PRIZES AT THE RUFFLE DRAWINGS
a) The ruffle drawings will be conducted on 18 April 2012. Winners will be selected randomly.
b) Winners are to be present at the time of the announcement. He/she is to present the winning ticket to redeem the prize. In the event that the announced winner is not present after three (3) repeated announcements, the winning will be deemed forfeited and a new winner will be picked.
c) All prizes are non-transferable and there is no cash alternative.
d) We make no warranties or representations whatsoever with respect to the prizes and shall not be responsible nor liable for any problems and/or damage thereto or arising there from.
6) PHYSICAL CONDITION AND RISK OF INJURY
a) Participants fully understand that he/she is engaging in adance fitness exercise which is considered a physical exercise at the Party, which may cause injury or a risk of abnormal body changes to him/her. He/she hereby agrees that he/she is a voluntary participant at the Party and that he/she is assuming all risks of injury or of abnormal body changes to him/her on account of this activity. We will not perform and is not required to perform any evaluation of the participant’s physical condition, which might result in the identification of risk factors contradicting and/or prohibiting physical exercise prior to his/her health, safety, comfort, or physical condition, or that of others. The participant further undertakes that he/she will consult his/her physician before participating in the Party.
7) LIMITATION OF LIABILITY
a) We accept no responsibilities and will not be liable for any problem, damage, loss, theft, injury, costs, expenses or any other claims for compensation of whatsoever nature to any participant resulting from their participation in the Party. We advise all participants NOT to bring any valuables to the Party. Should the participants insist on doing so, it may be done at his/her own risk.
b) We reserve the right to search the bags and other personal property of all participants in appropriate circumstances.
